1. Introduction
This document summarizes the conditions of sale that are applied for the purchase of products through the e-commerce site www.market2ruote.it by users defined below as Customers.

2. Acceptance of the conditions of sale
When placing an order, the customer fully accepts the General Conditions contained herein. Market 2 Ruote s.r.l. reserves the right to vary the content of these conditions. Any changes are considered valid from the time of their publication on the site.
When placing an order, the customer cannot enter false or invented names; should it occur, the seller reserves the right to report the fact to the competent authority for the protection of consumers.
The customer is also required to verify their personal data entered in the orders: the seller is not responsible for errors due to incorrect or incomplete information provided by the customer.
The contract stipulated between Market 2 Ruote and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Market 2 Ruote, which reserves the right to accept the order. Acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to accept the general and payment conditions transcribed below.
If the Customer is a final consumer, once the online purchase procedure has been completed, he will print or save an electronic copy and, in any case, keep these general conditions of sale, in compliance with the provisions of Articles. 3 and 4 of Legislative Decree n. 185/1999 on distance selling.
Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.
In order to make purchases on the site, the customer must be of age.
3. Methods of payment
For the payment of the order placed, the Customer can choose between the following methods:
- Credit card: In the case of purchases by credit card, at the same time as the online transaction is concluded, the reference bank will authorize only the commitment of the amount relating to the order placed. The amount relating to the Products purchased will be effectively charged to the Customer's credit card only when the order is placed by the seller.
The Customer must be the holder of the valid credit card when ordering the Products purchased online.
At no time is the seller able to know the information relating to the customer's credit card, transmitted via a secure connection directly to the site of the bank that manages the transaction. Market 2 wheels cannot in any case be held responsible for any fraudulent use of credit cards by third parties, upon payment for Products purchased on the site.
- Paypal: In cases of purchase through the PayPal payment method, the amount relating to the order is charged to the PayPal account at the time the order is acquired.
In the event of cancellation of the order or exercise of the right of withdrawal by the customer, the amount will be refunded to the customer's PayPal account, but the 4% commission charged by paypal towards Market 2 Ruote will be retained.
At no time during the purchase procedure is Market 2 Ruote srl able to know the Customer's financial information. There is no possibility that this data will be intercepted.
- Bank transfer: in this case the Customer must make the transfer of the amount indicated in the transaction, including shipping costs, to the credit institution or current account number indicated in the order confirmation e-mail . The goods will be shipped only after receiving full payment. No bank charges can be charged to the seller.
In case of exercise of the right of withdrawal by the Customer, the amount paid will be returned using the same payment method used by the customer for payments by bank transfer, credit card and paypal. The bank transfer will be used for payments made by cash on delivery.
4. Prices
The prices applied to each sale are indicated in the seller's catalog in effect at the time of purchase.
The prices are shown in Euro currency and are understood to be firm and irrevocable until a different publication on the site. Any changes will not be applied to orders already received.
The website shows the VAT excluded price or the VAT included price according to the display area. The Customer's area allows you to consult the prices for the delivery of products in your area.
The price including VAT is the price applied for all countries belonging to the European Union (EU) in consideration of the destination and the tax legislation in force.
For customers from countries outside the European Union, the actual price of the goods purchased is equal to the price without VAT. In this case, the customer will then pay the local taxes and customs duties applied in his country.
The Customer's BELONGING area is considered the DESTINATION area of the goods. An amount equal to the shipping costs is added to the total value of the order. This amount is calculated automatically and shown to the customer at the time of purchase based on the weight and destination of the goods purchased. Shipping costs are indicated in the "shipping costs" section.
5. Correctness of the information presented
Market 2 Ruote s.r.l. reserves the possibility that the characteristics of the products sold may change with respect to what is proposed in its catalog, in the event that the producers modify these products without giving prior notice. The customer can in this case refuse the purchase as indicated in the "Right of Withdrawal ".
Market 2 Ruote s.r.l. is not responsible for any typographical and / or photographic errors, for example but not only those relating to the indication of the sales prices shown in the catalog.
In the event that an incorrect and / or clearly derisory price is published, for any reason (error in our systems, human error, etc.), the order will be canceled, even in the case of initial validation.
The acceptance of the order by Market 2 Ruote s.r.l. is considered confirmed at the time of sending the order confirmation via e-mail from Market 2 Ruote s.r.l. to the client.
6. Warranty
The warranty on products purchased through the Market 2 Ruote s.r.l. is supplied by the respective manufacturer.
The warranty conditions ensured by the manufacturer cover a period of 24 months from the date of issue of the receipt, against material or manufacturing defects, and guarantee free replacement or repair. In case of invoicing, the guarantee is 12 months. To request the guarantee, the receipt or purchase invoice must be presented. Shipping costs are charged to the customer.
Any complaint regarding the products purchased must be sent directly to Market 2 Ruote s.r.l. at Via Circonvallazione Est, 4 31033 Castelfranco Veneto (Tv) Italy, by e-mail or certified e-mail or other similar means that allows written proof of receipt, within 8 days of discovery.
However, the following are excluded from the guarantee: normal wear and tear of the products; inexperience in use, poor conservation or treatment of the product, repairs and / or modifications to the product.
Market 2 Ruote s.r.l. is not responsible for damage or accidents due to defects in the products supplied through the sales contract, or for improper use or maintenance by the customer.
Each buyer is responsible for the correct use and compliance with local laws in the use of the equipment provided through our services.
7. Delivery times and methods
The times indicated for the shipment of orders are subject to possible changes / delays, especially if the product is not available and must in turn be ordered from the manufacturer. In the presence of a shipment that cannot take place on schedule, the Customer will be kept updated on the existing delay and will have the possibility to wait or to cancel the order.
Market 2 Ruote s.r.l. CANNOT be held responsible for damage or loss suffered by the goods during shipment. All shipments weighing more than 3 kilos are insured, while for other shipments the insurance is applied on specific customer request. Shipments are made at the risk of the customer and the customer himself assumes the responsibility to claim against the shipping service for any damage suffered. For this type of inconvenience, the customer must directly contact the carrier of whom he will have information at the time of confirmation of the shipment of the goods.
To this end it is necessary that the customer, upon receipt of the goods, carefully checks the external packaging. If it is ascertained the imperfect integrity, the customer must immediately notify the courier, expressly indicating in the delivery note that the goods are accepted with reserve. The insurance does not operate in the event that the customer has received the product without checking the packaging and without expressing reservations.
The customer must in any case notify Market 2 Ruote of the presence of the damage no later than 8 calendar days from receipt of the goods.
8. Right of Withdrawal
As required by Legislative Decree No. 185/1999, which regulates distance contracts, the consumer can exercise the right to withdraw from the purchase contract within 14 days of receipt of the goods. This right can be exercised by sending, within the prescribed period, a written communication by registered letter with return receipt to the following address: Market 2 Ruote s.r.l. It is also possible to send the declaration of withdrawal by fax or e-mail within the same term, provided it is followed by confirmation within the following 48 hours by registered letter with return receipt.
If the right of withdrawal is exercised, the purchased goods, intact and unused, must be returned at their own expense to Market 2 Ruote s.r.l. Via Circonvallazione Est 4, 31033 Castelfranco Veneto TV within 14 day from the day of receipt of the goods (the date of the postmark of return). In no case will parcels be withdrawn cash on delivery or carriage forward and in any case at the expense of the recipient.
In case of correct exercise of the right of withdrawal, Market 2 Ruote s.r.l. will refund the sums collected after receiving the goods and verifying the conditions. In any case, the shipping costs of the goods that remain at the expense of the customer will not be made. In the case of purchase with free shipping, the costs incurred for shipping will be deducted from the refund, equal to € 9.00.
9. JURISDICTION
For any dispute, the Court of Treviso (Italy) is competent.
